“The respondents’ failure and continued refusal to pay their long overdue deficiency tax assessments, despite repeated demands, constitute willful failure to pay the taxes due to the government,” BIR said in a statement.

Charged with violating Section 255, in relation to Sections 253 and 256 of the Tax Code were E & D Parts Supply Incorporated, its chairman Cipriano C. Uy, and treasurer Margaret L. Uy.

E & D is a domestic corporation engaged in trading auto spare parts, with office address in Paco, Manila. For taxable year 2006, E & D, together with its responsible officers, was assessed with deficiency tax liabilities in the sum of P30.03 million ($687,812), inclusive of income tax (IT) of P22.14 million ($461,290) and Value Added Tax (VAT) of P7.89 million ($180,713).

Charged with the same violation were Haldane Philippines Incorporated, its chairman Hua Cuen Uychiyong, and chief finance officer Cherry Uyco-Ong. 

Haldane is a domestic corporation duly registered with the Securities and Exchange Commission (SEC), with business office in Malate, Manila. Haldane and the officers charged were assessed with a deficiency VAT liability for taxable year 2007 in the aggregate amount of P8.92 million ($204,305), inclusive of increments such as IT and VAT.

The cases were filed under BIR’s Run Against Tax Evaders (RATE) program.
