MANILA, Philippines – Philex Mining Corp. has asked the Mines and Goesciences Bureau (MGB) for a 7-day extension for the filing of its comment on the P1.034 billion fine imposed on the company for the tailings spill at its copper-gold mine in Padcal, Benguet.
MGB Director Leo Jasareno told reporters on Wednesday, October 3, that he received the letter from Philex on Tuesday, October 2, the day when the original 7-day deadline for its official response was due.
Jasareno said Philex wants to conduct further studies on the fine an collect supporting documents.
The MGB will deliberate on the request and would immediately inform the company of its response.
Philex spokesperson Mike Toledo earlier said they will contest the P1-billion fine citing force majeur or factors beyond its control as reason for the leak, and not Philex’s negligence, which Toledo said should be the basis for massive penalties.
The P1-billion fine is based on Mining Act violations.
On top of this is another P50,000 fine announced on October 2 that was based on violations of its Environmental Clearance Certificate (ECC), a key factor for the previous reward of Philex’s mining contract. – Rappler.com
