MANILA, Philippines  – Another rape complaint against actor-comedian Vhong Navarro has been dismissed. 

According to a report from Pep, Vhong’s lawyer Alma Mallonga said in a statement that the complaint filed by stunt double Margarita Fajardo has been junked for “lack of probable cause” by the Quezon City Prosecutor’s Office.

The resolution, according to Mallonga, was given on October 15. 

“The rape complaint of Mai Fajardo vs Vhong Navarro has been dismissed for lack of probable cause per resolution dated 15 October 2014 signed by Assistant City Prosecutor Nilda Ordoño, John Patrick Corpuz [recommending approval], and approved by City Prosecutor Donald Lee. 

“In essence, apart from the long delay before the complaint was filed, the dismissal was anchored on the failure to establish force or intimidation,” the statement said. 

The resolution also said that the complainant had no reason to be afraid of Vhong because the alleged incident happened with many people around them.

“Aptly, her side remark, ‘Okay ka na? Baba na ako‘ (Are you okay? I will go down) was not in keeping with a fear-struck person who was cowed into submission.”

In April, the complainant in her affidavit said that she was invited by Vhong to go inside a vehicle during a taping of a show, which Vhong is part of in 2009.  The complainant, who said she was gay, accused him of forcing her to perform a sex act on him.

Margarita Fajardo’s complaint against Vhong is the fourth rape case dismissed against the It’s Showtime host. In April and July, the Department of Justice dismissed the two rape complaints filed by model Deniece Cornejo.
