The following terms and conditions govern the relationship between Rappler and each funder, including the terms on which contribution may be accepted, refused, or returned by Rappler. AGREEMENT By subscribing and supporting Rappler’s projects, a funder agrees and acknowledges that:
  • the contribution is provided to Rappler as a support for its legal defense and to ensure its protection from harassment and threats, subject to any exercise of the subscriber’s right to receive a refund as described below and Rappler’s right to return any contribution at its discretion;

2. CONDITIONS Contributions will be accepted from individuals as well as other legal entities. Contributors who are individuals must be aged 18 or over. Contributors who are not incorporated, established and/or registered in the Philippines are governed by the laws of their native country. 3. ADMINISTRATION OF CONTRIBUTIONS All contributions to Rappler shall be made through the contributions page or widget on rappler.com (the “Rappler Website”). Contributions will be accepted by Rappler for the period during which the contributions page or widget is live on the Rappler Website. Contributions received by Rappler will be deposited in one or more bank accounts in the name of Rappler together with other Rappler funds. Each contribution will be identifiable by a unique merchant identification number and accounted for separately by Rappler. From the moment the contribution is processed, Rappler will be legally and beneficially entitled to the full amount of the contribution and the subscriber has no entitlement to the return of a contribution in any circumstances other than as specified in these Terms and Conditions. The contributor shall receive updates from Rappler in return for any contribution and shall have no right to influence the editorial policy or output of Rappler. Contributions to Rappler are not charitable donations under the law of the Philippines, as far as Rappler is aware, contributors shall not be entitled to any tax relief in respect of their contributions nor are any contributions eligible for “gift aid” either in the Philippines or in any other jurisdiction worldwide. Contributors are liable for the corresponding taxes that are associated with their donation. Rappler will not cover donor’s taxes 5. REFUNDS AND CANCELLATION OF CONTRIBUTIONS Rappler reserves the right to refuse and return any contribution in its absolute discretion, including without limitation where it believes that accepting the contribution would conflict with the mission, values or interests of Rappler, and/or where, having regard to the source of the contribution or intentions of the subscriber, Rappler considers that to accept the contribution could damage the independence or reputation of Rappler or adversely affect the relationship of Rappler with other contributors or stakeholders. Contributions are not eligible for a refund unless Rappler deems it necessary to provide the refund or refuse the contribution. 6. TRANSPARENCY OF CONTRIBUTIONS Rappler reserves the right to:
  • request the full name and contact details of the subscriber;
  • request from the subscriber any other information that it considers to be necessary or desirable to determine the provenance of the contribution;
  • undertake any further investigations it deems fit to determine the provenance of the contribution; and
  • publicly disclose the identity of the subscriber and the amount of the contribution
If the subscriber refuses to provide any information requested by Rappler under clause 5.1, Rappler may refuse and return the contribution to the subscriber at its discretion. 7. CONFIDENTIALITY AND PUBLICITY Contributors shall not be entitled to publicize their contribution or otherwise market themselves or any connected person or business in connection with their contribution, except with the prior written consent of Rappler and then only if the subscriber complies with any relevant policies, procedures or requirements of Rappler. 8. DATA PROTECTION AND PRIVACY If a subscriber opts in to receive information relating to offers from Rappler via the email address supplied by the subscriber then he or she may unsubscribe at any time by contacting funding.support@rappler.com. Any personal information about a subscriber obtained by Rappler as a result of a contribution being made will be used in accordance with the Rappler privacy policy, available here. By making a contribution, the subscriber accepts the terms and conditions of the privacy policy. 9. EXCLUSION OF LIABILITY Neither Rappler nor any affiliated person, employee, agent, officer or director shall be liable for any loss suffered by any donor or other person arising out of or in connection with a contribution, whether direct or indirect, including loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, except in respect of any liability for death or personal injury or any other liability which cannot be excluded or limited under applicable law. 10. MISCELLANEOUS A failure of Rappler to assert a right or provision under these Terms and Conditions shall not constitute a waiver of that right or provision. If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.
