Ex-Lanao mayor indicted for non-disclosure of assets in SALNs
MANILA, Philippines – The Office of the Ombudsman has indicted a former mayor of Lanao del Sur for failure to declare firearms and a vehicle in his Statements of Assets, Liabilities and Net Worth (SALNs).
Former Marantao mayor Mohammadali Abboh Abinal was indicted for 6 counts each of violation of Section 8 of the Code of Conduct and Ethical Standards for Public Officials and Employees, and Article 183 of the Revised Penal Code (RPC) for non-declarations in his SALNs from 2007 to 2012.
Article 183 of the RPC penalizes untruthful statements under oath, in an afidavit or in "any material matter before a competent person to administer an oath."
"It was found that Abinal failed to declare five firearms and a vehicle in his SALNs from 2007 to 2012," the Office of the Ombudsman said in a statement on Thursday, June 7.
In its resolution, the Office of the Ombudsman considered the non-declarations a "willful and deliberate assertion of a falsehood."
“His claims that his firearms were either confiscated or lost and that his truck was scrapped are matters of defense involving factual issues, hence, should be fully explained and threshed out not in a preliminary investigation but during trial,” the resolution said.
Abinal was among those in President Rodrigo Duterte's first list of alleged drug personalities who surrendered to the Philippine National Police in August 2016 to pledge support for the new leader's campaign against illegal drugs. Abinal, who was released as there was no pending case against him, had admitted involvement in the drug trade from 2000 to 2002, but not since then. – Rappler.com
