Miriam: Instagram photos admissible proof vs Binay
Senator Miriam Santiago cites a jurisprudence that says the 'our place in Batangas' posts of the Vice President's youngest daughter can be used against Binay in court

MANILA, Philippines – The Instagram posts of Joanna Marie Binay, the youngest daughter of Vice President Jejomar Binay, claiming family ownership of the controversial 350-hectare “Hacienda Binay” in Rosario, Batangas, may be submitted as evidence in court, according to Senator Miriam Santiago.

“The Instagram post is admissible in evidence against Binay as admission against interest,” Santiago said in a presser on Thursday, November 6.

Binay’s daughter posted in social media photos of various family activities inside the property. One caption read: “Our place at Batangas.” The account has been deactivated.

Senator Alan Cayetano displayed the social media posts during last week’s probe into the allegedly overpriced Makati City Hall II Parking Building. The Vice President said Cayetano crossed the line when the senator dragged his daughter into the controversy.

Santiago cited Supreme Court ruling Unchuan v. Lozada as a legal precedence.

She explained: “On this point, the Supreme Court held that “admission against interest are those made by a party to a litigation, or by one in privity with, or identified in legal interest with, such party and are admissible whether or not the declarant is available as a witness.” – Rappler.com
