BAGUIO CITY, Philippines – Nothing’s stopping the anti-graft court Sandiganbayan from continuing its proceedings with the latest graft and malversation cases against former Makati mayor Elenita Binay before the court’s Third Division.

In a resolution dated January 14, the SC denied the Mrs Binay’s petition against two resolutions upholding her indictment dated January 6, 2015 and September 8, 2014 of the anti-corruption and prosecutorial body Ombudsman.

The High Court found the Ombudsman resolutions to be sound, finding no merit in Binay’s claim that they were issued with grave abuse of discretion.

“The Court resolves to DISMISS the petition for failure to show any grave abuse of discretion in rendering the challenged memorandum and consolidated resolution which, on the contrary, appear to be in accord with the facts and the applicable law and jurisprudence,” the resolution read. 

SC Associate Justices Presbitero Velasco Jr and Diosdado Peralta took “no part” in the voting on the case “due to their relationship with a party,” the resolution read.
