MANILA, Philippines – Election lawyer Emil Marañon got a number of encouraging messages from netizens when Rappler broke the news that he had asked the Commission on Elections (Comelec) to reject the candidacies of spouses Alan Peter and Lani Cayetano in Taguig.
Alan and Lani are running for representatives of the city’s two congressional districts – the husband in the first district, and the wife in the second district.
Representing Taguig voter Leonides Buac Jr, Marañon said the Comelec should cancel the two candidates’ certificates of candidacy, where they declared different addresses. Under the law, he said, spouses are obliged to live together in the same domicile, so the different addresses they used means one of them made a misrepresentation – a ground for canceling one’s candidacy.
The complaints ask the Comelec to not only consider the “legal infirmities” of the Cayetano spouses having different residences, but for the poll body to resolve the case as a violation of the Constitution’s anti-dynasty provision.
